Terms and Conditions – Ibiza Routeplan
These terms and conditions apply to all offers and orders of digital products via the Ibiza Routeplan webshop on www.ibizarouteplan.com. Ibiza Routeplan sells digital products intended for use during a stay in Ibiza and Formentera. By placing an order (such as downloading free or paid products), you agree to these terms and conditions.
- Offers, Prices, and Payments
1.1 The listed prices for the offered products and services are in euros and include 9% or 21% VAT.
1.2 Ibiza Routeplan reserves the right to change prices at any time.
1.3 Payment for digital products is made online via the available payment methods. After successful payment, the product is delivered digitally and automatically via email.
1.4 By placing an order and making payment for a digital product, a definitive purchase agreement is established.
1.5 This agreement grants the buyer a non-exclusive and non-transferable right to use the purchased digital product. All intellectual property rights remain at all times with Ibiza Routeplan.
- Intellectual Property Rights
2.1 All intellectual property rights related to the digital products – both as a whole and in part – remain the property of Ibiza Routeplan.
2.2 The buyer agrees not to perform any actions that infringe upon these rights.
2.3 Ibiza Routeplan guarantees that the delivered digital products do not infringe upon the rights of third parties.
- Contests and Giveaways
3.1 Ibiza Routeplan occasionally organizes contests or giveaways. Participation is voluntary and free, unless otherwise stated.
3.2 The winner is chosen at random from valid entries. No correspondence will be entered into regarding the result.
3.3 A won prize cannot be exchanged for cash or other products.
3.4 Ibiza Routeplan reserves the right to modify, pause, or cancel contests at any time.
3.5 In case of suspected fraud or abuse, participation may be excluded.
3.6 Participants must be 18 years or older, unless stated otherwise.
3.7 Personal data collected for a contest is used solely for communication related to the contest and will not be shared with third parties. See also our privacy policy.
- Liability and Responsibility
4.1 Ibiza Routeplan is not liable for any damages resulting from the use of digital products.
4.2 Delivery and communication are conducted via email and the internet. The buyer is responsible for providing correct contact details and for properly configuring their software (such as spam filters and antivirus programs) to ensure they can receive digital products.
- Copyright and Usage Restrictions
5.1 All digital products from Ibiza Routeplan are protected by copyright. It is not permitted to copy, distribute, or commercially exploit these products.
5.2 It is also not allowed to create derivative works, modify the content, and then distribute or use it commercially.
- Cancellation and Returns
6.1 Digital products from Ibiza Routeplan are not subject to the right of withdrawal. Cancellation of an order that has already been processed and delivered is not possible.
- Partners and External Offers
7.1 Ibiza Routeplan occasionally collaborates with external partners to offer customers additional benefits, discounts, or promotions.
7.2 Although Ibiza Routeplan carefully selects these partners, it is not responsible or liable for the products, services, or fulfillment of agreements by these external parties.
7.3 The customer is solely responsible for entering into agreements with partners and must adhere to the terms and conditions set by those parties.
7.4 Any complaints or questions about partner services must be submitted directly to the respective partner.
- Miscellaneous
8.1 If one or more provisions of these terms conflict with applicable law, the affected provision will be void and replaced by a similar, legally valid provision.
8.2 These terms and conditions are governed exclusively by Dutch law.
8.3 All disputes will be submitt
ed to a competent court in the Netherlands.
