General Terms and Conditions for Digital Products

These general terms and conditions apply to all offers and orders of digital products available for purchase on www.ibizarouteplan.com. Making use of an offer or placing an order (i.e., downloading free or paid products) through the Ibiza Routeplan webshop means you accept these general sales terms and conditions.

1. Offers, Prices, and Payments
1.1 The prices listed for the offered products and services are in euros and include 9% or 21% VAT.
1.2 Payment for the offered digital products on www.ibizarouteplan.com is made online via the provided payment methods. The product is delivered digitally and automatically via email after successful payment.
1.3 By placing an order and paying for a digital product, the buyer enters into a final purchase agreement with Ibiza Routeplan.
1.4 A final agreement grants the buyer a non-exclusive and non-transferable right to use the digital products. The intellectual property rights and legal authorship remain at all times with Ibiza Routeplan.

2. Intellectual Property Rights
2.1 All intellectual property rights concerning digital products, both in their entirety and in parts, remain the unaltered property of Ibiza Routeplan. You are obliged to refrain from any action that infringes on intellectual property rights.
2.2 Ibiza Routeplan guarantees that the digital products delivered to you do not infringe on any third-party intellectual property rights.

3. Liability and Responsibility
3.1 Ibiza Routeplan is not liable for any damage that may result from the use of the respective products.
3.2 Ibiza Routeplan is not liable for behavior that may result from the use of the respective products. Ibiza Routeplan advises against engaging in behavior that creates dangerous situations for yourself or others. No actions should be taken that correspond in nature and scope with those prohibited by local ordinances and laws. Always follow the instructions of the local competent authorities. These always take precedence.
3.3 Correspondence and/or delivery takes place via email and the internet. You are responsible for providing the correct (email) address to Ibiza Routeplan. Additionally, you are also responsible for properly setting up your PC and any existing programs such as firewalls, spam filters, and virus scanners so that messages and digital products sent to you can be received.

4. Copyright and Prohibited Use of Downloads
4.1 The digital products of Ibiza Routeplan are copyrighted. Therefore, it is not allowed to copy, distribute, and/or commercially exploit the purchased digital products.
4.2 It is not allowed to create “derivative works” by modifying the downloads and then distributing or commercially exploiting them.

5. Order Cancellation
5.1 There is no right of return for digital products from Ibiza Routeplan. For this reason, it is not possible to cancel orders that have already been executed and delivered.

6. Miscellaneous
6.1 If one or more of the provisions of these Terms conflict with any applicable law, the respective provision will lapse and be replaced by a new comparable provision to be determined by Ibiza Routeplan.
6.2 These terms are exclusively governed by Dutch law.
6.3 All disputes between parties will be submitted exclusively to a competent court in the Netherlands.
6.4 In the case of a translated version, the Dutch text and Dutch law always apply. A version in another language is for reading purposes only and does not grant any rights.
